Terms of Service

Last updated October 21, 2026. How we agree a project, how payment works, and why we fix problems with revisions rather than refunds.

The short version

  • Every project starts with a written Service Level Agreement (SLA) that we send you by email. It becomes binding when you confirm it.
  • We always take at least 50% upfront before any work begins. At checkout you can pay in full or pay a 50% deposit; any balance is due before launch or handover.
  • Once you have confirmed your SLA, payments are not refundable. If something isn't right, we fix it through revisions.
  • If you stop responding for 30 days, your SLA is cancelled and what you have paid is kept for the work and time already committed.

The full terms below are what apply. This summary does not replace them.

1. Who these terms apply to

These terms apply to anyone who uses this website or buys services from Bark Boost Solutions ("Bark Boost", "we", "us"), of 320 N Broadway, Suite 2 #16, Hicksville, NY 11801, USA. "You" or "the client" means the person or business buying from us.

Our services are sold to businesses. By buying from us you confirm that you are acting for a business (including as a sole trader) and not as a private consumer, and that you have authority to agree to these terms on that business's behalf.

2. How an agreement is made: the SLA

2.1 What the SLA is

Before work starts we email you a Service Level Agreement (SLA). It sets out the scope of work, the deliverables, the price, the payment schedule, the timeline, and the number of revision rounds included.

2.2 When it becomes binding

The SLA, together with these terms, becomes a binding agreement as soon as any one of the following happens:

  • you reply to the SLA email confirming, accepting, or acknowledging it (for example "confirmed", "approved", "agreed", or "go ahead");
  • you sign the SLA, in writing or electronically; or
  • you pay the upfront deposit or any other payment for the work it describes.

An email confirmation counts as your signature. We keep a copy of every SLA and every confirmation.

2.3 Instant checkout

If you buy a fixed-price package through our online checkout, you must tick a box confirming that you have read and agree to these terms, including the no-refund policy, before you can pay. The package description and these terms form your agreement from the moment you pay. That moment counts as your confirmation under section 2.2. We then email you a written receipt and an SLA that confirms the details; neither changes the price you paid.

2.4 If the SLA and these terms differ

If your SLA says something different from these terms about your project, the SLA wins for that project. Everything the SLA doesn't cover is governed by these terms.

2.5 Electronic agreement and our records

You agree to do business with us electronically. Ticking a box at checkout, replying to an email to confirm or approve something, or paying online is your signature, with the same effect as signing on paper. Before you can pay online, we email a one-time code to the address you give us, and you confirm it at checkout. This verifies that you control that email address. After you pay, we email your order details from info@barkboostsolutions.com and ask you to confirm them, by pressing the confirm button on the page linked in that email or by replying "I confirm". Please check them carefully and tell us straight away if anything is wrong. We keep records of each of these steps, including the date and time, the IP address and browser used, the email verification, the exact wording you agreed to, the version of these terms in force, and the description, price and timeline of what you bought as shown at checkout, the emails we send you, your confirmations and stage approvals, and the payment confirmation from our payment provider. You agree that these records, together with our emails and messages with you, can be used as evidence of what was agreed and delivered, including in a payment dispute.

3. Payment

3.1 At least 50% upfront, always

We require a payment of at least 50% of the project price before any work begins. We do not schedule, design, or build anything until it has been received.

When you buy a website build or bundle at our online checkout, you choose how to pay:

  • Pay in full: the whole price today. Nothing more is due for the package.
  • 50% deposit: half the price today, rounded up to the nearest dollar, with the balance due as described in section 3.2. Checkout shows both amounts before you pay, and your receipt confirms them.
  • Payment plan (where offered): see section 3.3. A payment plan counts as meeting this requirement.

Other purchases, such as the Website Teardown, are paid in full at checkout. The deposit is a payment like any other and is covered by section 4.

3.2 The balance

If you paid a deposit, the remaining balance is due when the work is ready for launch or handover, and in any case before we publish a site to your domain, transfer files, or hand over accounts or source material. We invoice the balance when the work is ready. Choosing to pay a deposit does not reduce the price or the scope; you owe the full price from the moment you pay the deposit. Larger projects may have milestone payments set out in the SLA.

3.3 Payment plans

If you pay in instalments, you owe the full plan amount from the moment you agree to the plan at checkout or confirm your SLA. Cancelling a PayPal subscription or stopping a card payment does not cancel what you owe. If an instalment fails and is not paid within 7 days of our reminder, all remaining instalments become due immediately and we may pause work until they are paid.

3.4 Monthly plans

Monthly plans are billed in advance at the start of each billing period. They continue until you cancel as described in section 9.

3.5 Third-party costs

Domain names, hosting, paid plugins, stock images, software subscriptions, and advertising spend paid to platforms such as Google or Meta are separate from our fees. They are paid to those third parties, are subject to their terms, and cannot be refunded by us.

3.6 How the charge appears

Online payments are processed by PayPal or, if you choose "Pay by card", by Stripe. They appear on your card or bank statement under the name BARKBOOST, sometimes alongside "PAYPAL". If you see a charge you don't recognise, email us before contacting your bank.

3.7 Late payment

If a payment is late we may pause all work and services until it is paid. Timelines move by at least the length of the delay. Unpaid amounts may be passed to a collection agency, and you agree to cover reasonable costs of recovering them.

3.8 Digital products

Some products, such as the Dog Business Masterplan, are digital. You get access through a private link as soon as your payment goes through, and we email the link to you as well. There is no SLA and no revision rounds for a digital product, and because you can open it straight away, the sale is final and non-refundable. If your link doesn't work, email us and we will resend it. The link is for you and your business only; please don't share or resell the content. Digital products give general guidance, not a promise of any particular result.

4. Our no-refund policy

4.1 All payments are final once the SLA is confirmed

As soon as your SLA is confirmed (section 2.2), every payment you make is final and non-refundable. This includes deposits, upfront payments, milestone payments, instalments, full payments, and monthly fees. When you confirm an SLA we reserve time in our schedule, turn other work away, and start planning your project. That commitment cannot be undone.

4.2 Things that are not grounds for a refund

To be clear, we do not give refunds, partial refunds, or credits because:

  • you have changed your mind, or no longer want or need the service;
  • you don't like the design, style, wording, or overall look after approving the direction or the mockups. Taste is handled through revisions (section 5), not refunds;
  • your business has closed, been sold, changed direction, or changed its budget;
  • you found another provider, a cheaper option, or decided to do it yourself;
  • you didn't send content, photos, logins, approvals, or feedback when needed;
  • you stopped responding to us (section 7);
  • the project was delayed by anything on your side;
  • you expected results we never promised, such as a ranking, a number of leads, bookings, calls, or a level of revenue (section 10);
  • a third party caused a problem, for example a Google or Meta account suspension, a hosting outage, a change to a platform's rules, or a booking tool you chose;
  • you have only used part of the service, or not used it at all;
  • you cancelled part-way through a project or billing period.

4.3 No money-back guarantees

We don't offer money-back guarantees on any service. Where this site describes what we will do in your first 30 days, how quickly we will set things up, or how we will fix problems, that is a commitment to do the work, not a promise of a refund. Nothing said on a call, in a chat, or in our marketing creates a right to a refund unless it is written into your SLA.

4.4 Rights the law doesn't let us exclude

Nothing in these terms removes a right that the law says cannot be excluded by contract. If any such right applies, it is limited to the minimum the law requires.

5. Revisions, not refunds

5.1 How we handle "I don't like it"

If you are unhappy with something we have delivered, tell us what you want changed and we will revise it. That is how dissatisfaction is resolved under these terms. Saying "I don't like it" is a reason for a revision, not a refund.

5.2 Revision rounds

Your SLA states how many revision rounds are included for each stage of the work. If your SLA doesn't state a number, three (3) rounds per stage are included. A round is one consolidated list of changes, sent in one message. We make all the changes on that list, then send the work back to you.

5.3 What counts as a revision

A revision is a change within the scope you approved: adjusting text, colours, images, layout, or features that are already in the SLA. Asking for a new feature, a new page, a completely new design direction after you approved one, or anything outside the SLA is a change request. We will quote it separately, and it may move the timeline.

5.4 Approvals

Work moves in stages (for example: design, then build, then launch). You approve a stage by pressing "I approve this stage" on the page we link to in our email, or by replying "Approved". When you approve a stage, it is locked. Reopening an approved stage is a change request. If we send you something to review and you don't reply within 7 days, we will send one reminder; if you still don't reply within 7 more days, that stage is treated as approved and we continue.

5.5 Post-launch fixes

For 30 days after a website launches, we fix anything we built that breaks or doesn't work as described in the SLA, at no charge. This covers defects in our work. It does not cover new requests, changes made by you or someone else, or problems caused by your hosting or third-party tools.

6. What we need from you

You agree to:

  • give us accurate information, and the content, photos, logins, and access we ask for;
  • reply to our questions and review requests within 5 business days;
  • keep the email address and phone number in your SLA working and checked. Notices we send to those details count as received, even if you don't read them;
  • have the rights to any material you give us (logos, photos, text);
  • pay on time.

Every deadline in the SLA depends on you doing these things. If you are late, our deadlines move by at least the same amount.

7. If you go quiet

Projects stall when we can't reach the client. This section explains exactly what happens, so there are no surprises.

7.1 What counts as going quiet

A project is considered inactive if you do any of the following and don't put it right after we contact you:

  • stop replying to email, WhatsApp, phone, or messages;
  • don't send the content, photos, logins, or access we need to continue;
  • don't review or approve work we have sent you;
  • miss two scheduled calls in a row without telling us in advance;
  • let your email bounce or your phone number stop working without giving us new details;
  • leave a payment unpaid, or don't fix a failed payment, after our reminder.

7.2 The timeline

The clock starts on the date of our first request that you don't answer.

  • Day 5 (business days): we send a reminder.
  • Day 14: the project is paused. We tell you by email. All agreed timelines and launch dates no longer apply.
  • Day 30: if we still haven't heard from you, your SLA is cancelled. We send a final notice by email.

We will make reasonable efforts to reach you before cancelling, using the contact details in your SLA.

7.3 What cancellation means

  • All payments you have made are kept and are not refunded. They cover the time we reserved, the work done, and the work we turned away.
  • If the work completed is worth more than what you have paid (for example, a finished build where only the deposit was paid), the value of the completed milestones becomes due.
  • We don't launch anything, transfer files, or hand over accounts until everything due is paid.
  • Any staging or preview site we host for you may be taken offline.
  • We keep your project files for 60 days after cancellation. After that we may delete them.

7.4 Coming back

If you contact us after cancellation and want to continue, we will need a new SLA, new timeline, and current pricing. We may, at our discretion, put part of what you already paid toward the new SLA. That is a goodwill credit, not a refund, and it is not owed to you.

7.5 Monthly plans

For monthly plans, going quiet does not stop billing. We keep doing the work we can with what we have. Your plan continues, and remains payable, until you cancel it as described in section 9.

7.6 Silence after launch-ready

If the work is ready for launch or handover and the balance is unpaid, the same timeline applies from the date we tell you it's ready. The finished work stays with us until the balance is paid.

8. Chargebacks and payment disputes

If you have a problem, contact us first at info@barkboostsolutions.com and give us 14 days to put it right before you open a dispute with PayPal, Stripe, your card issuer, or your bank.

Opening a chargeback or payment dispute for work covered by a confirmed SLA, without going through that step first, is a breach of these terms. If it happens:

  • we will pause all work and services immediately;
  • we will give the payment provider your SLA, your confirmation, our emails and messages with you, and the work we delivered;
  • you agree to repay any amount reversed, plus dispute fees and reasonable recovery costs;
  • no rights in the work transfer to you while any amount is disputed or unpaid.

9. Cancelling

9.1 Projects

You may cancel a project at any time by email. Payments already made are not refunded (section 4). Work completed beyond what you have paid for becomes due. Any instalments under a payment plan remain payable.

9.2 Monthly plans

Monthly plans have no minimum term. To cancel, email us at least 7 days before your next billing date, or with the longer notice stated on that plan's page or in your SLA. If we get your notice later, the next period is billed and payable. We don't give refunds or prorated credit for a period that has started.

9.3 When we can end the agreement

We may pause or end our work, with notice by email, if you don't pay, breach these terms, behave abusively towards our team, ask us to do something illegal or unethical, or don't give us the cooperation we need. If we end it for any of these reasons, payments made are not refunded and completed work is payable.

10. Results

We promise to do the work described in your SLA, to a professional standard. We do not promise particular results. Rankings, traffic, leads, calls, bookings, and revenue depend on things outside our control, including search engines, ad platforms, competitors, your pricing, your location, and how you handle enquiries. Not getting a result you hoped for is not a breach of these terms and not a reason for a refund.

11. Third-party services

We build on tools run by other companies, such as hosting providers, domain registrars, Google, Meta, PayPal, Stripe, booking software, and AI phone services. We are not responsible for their outages, price changes, policy changes, or account decisions, including suspensions. Their terms apply to your use of them.

12. Ownership of the work

12.1 Your materials

You keep ownership of the content, logos, and photos you give us.

12.2 Work we create for you

Once you have paid everything due under your SLA, you own the final deliverables we created for you and can use them for your business. Until then, they belong to us, and we may withhold them, take a staging site offline, or decline to transfer accounts.

12.3 What stays ours

We keep ownership of our own tools, templates, frameworks, and code libraries that we reuse across clients. You receive a permanent licence to use them as part of your delivered work. We may show the finished work in our portfolio unless your SLA says otherwise.

13. Confidentiality

We keep your business information and logins confidential and use them only to do your work. We may disclose information if the law requires it, if we need to in order to enforce these terms (for example, in a payment dispute), or with your permission.

14. Limits on our liability

Our total liability to you for any claim connected with our services is limited to the amount you paid us for the specific service the claim relates to in the 12 months before the claim. We are not liable for indirect or consequential losses, including lost profits, lost revenue, lost data, or business interruption. These limits do not apply where the law doesn't allow them to.

You agree to cover our reasonable costs, including legal fees, arising from material you gave us that infringes someone else's rights, or from your breach of these terms.

15. Warranties

Apart from what is written in your SLA and section 5.5, our services are provided "as is". We give no other warranties, express or implied, to the extent the law allows.

16. Events outside our control

Neither of us is responsible for delays or failures caused by events outside reasonable control, such as natural disasters, illness, government action, internet or power outages, or third-party service failures. Timelines move by the length of the event. This doesn't excuse any payment that is due.

17. Notices

We send notices to the email address in your SLA. A notice counts as received on the day we send it, unless we get a delivery failure message. You send notices to info@barkboostsolutions.com. A notice from you counts only once we have received it.

18. Disputes and governing law

If there is a disagreement, we will first try to resolve it directly with you by email or call. If that fails, these terms and every SLA are governed by the laws of the State of New York, USA, and applicable United States federal law, without regard to conflict-of-law rules. You agree that any dispute will be decided exclusively by the state and federal courts located in New York County, New York, and you consent to those courts' jurisdiction. Either of us may instead bring a claim in small-claims court if it qualifies.

19. General

  • Whole agreement: your SLA and these terms are the whole agreement between us. Things said on calls, in chats, or in marketing are not part of it unless they are written into your SLA.
  • Severability: if a court finds part of these terms unenforceable, the rest still applies, and the unenforceable part is applied as far as the law allows.
  • No waiver: if we don't enforce a term straight away, we can still enforce it later.
  • Changes: we may update these terms. The version on this page when your SLA was confirmed applies to that project. For monthly plans, changes apply from your next billing period after we tell you.
